In Australia, the term "black people" is often heard, a nickname for people who do not have a legal visa. In the past, in China, children who violated family planning were born in violation of family planning because they could not get a hukou, known as "household registration is not registered"; for those who are not subject to the moral bottom line, intermediaries who do anything to make money are referred to as "black intermediaries". In short, "black" here is a derogatory term, not only is not recognized in the law, but will also be severely hit.

Being a "Hei Min" in Australia, in law it means becoming a "Illegal non-citizens (Unfaul Non Citizen)".

"illegal non-citizens" means:

Within Australia, those whose visas have expired have not left;

The visa has not expired but failed to comply with the visa requirements, resulting in the cancellation of the visa and the non-departure of the person;

Never hold a legal visa or the like.

Under Australian law, "illegal non-citizens" are subject to compulsory "detention" if found, and "illegal non-citizens" are deported to (Deportation) after all the rights granted to "black people" under Australian law have been exhausted.

Especially since the Liberal Party goverment came to power, faced with the international and domestic forms, the illegal immigrants within the country have been severely cracked down, detained and repatriated immediately, and it is very difficult to obtain the opportunity of "bail".

In particular, in 2018, the Immigration Department has made a high-profile announcement that it will step up the fight against the people of the Black People! In particular, the Chinese black people are the key to roll-call!

How many of the people in the Black "black" are in Australia

According to an independent review by Australian legal expert Horwell (Stephen Howells), there could be between 50000 and 100000 illegal workers in Australia.

According to Senate estimates in May, 64600 non-Australian visas have expired, or 20000 of them are in illegal employment. But the figures do not take into account the large number of visitors to Australia via (visitor visas) visas. A significant number of these people are also in illegal employment. The number has doubled from about 30, 000 two years ago.

Of these 64,000, nearly 2 / 3 remained for more than two years. Immigration said they now know at least one person has been "black" in Australia for 40 years, and it is not clear whether the person is alive or dead. Of these triads, one in three has official jobs.

About 3 / 4 came to Australia on a tourist visa and 15 percent were international students. Of these, 1 / 3 has been in Australia for at least 10 years, and 18750 black people have been in Australia for more than 15 years.

The following is a statistical table of the "stay" time of the 64000 recorded black people:

The main source of the black people in Australia

Malaysia-approximately 9440

China-more than 6500 people

United States-about 5710 people

Britain-about 3680 people

Followed by Indonesia, India, South Korea, the Philippines, Vietnam and Thailand, with an illegal population of about 2, 200 people. In addition, Germany, France, Japan and Fiji also have a number of illegal residents in Australia.

Chinese and Malaysian nationals account for about 1 / 4 of Australia's illegal immigrants, ranking first among the black population.

The Australian Chinese area will be a key target for the Immigration Service, with restaurants and shops in Sydney's Chinese districts such as Campsie and Burwood as key targets, according to Perth Now.

Earlier, the Australian Immigration Society had called on the goverment to consider giving these people a legal status. Instead of letting these people continue to live without sunshine, legalize their identities and learn more about them. In the late 1970s, Australia granted amnesty to nearly 8000 overstayers.

Immigration operations in the past

Since 2015, the Australian Immigration Service and Customs have been merged into the ABF (Australian Border Force), to defend the Australian border. Also this year, goverment set up a multi-agency, professional working group-Cadena,-to target and dismantle visa fraud, illegal work or labour exploitation.

In 2015, immigration officials planned to take to Melbourne's streets and randomly "chat" with passers-by. A spokesman for the Immigration Board said everyone needed to pay attention to their visas and that anyone who broke the visa regulations would be arrested immediately and sent to (Detention Centre)., a detention centre. But the plan was cancelled after popular complaints and even protests.

However, ABF did not stop them from doing so. In December 2016, more than 20 black people were arrested on a farm in Melbourne with efforts by the Australian police, including the ABF, Australian Police, to arrest more than 20 black people.

Some people in the legal visa period, not a big mistake, safe until the expiration of the visa, but for different reasons have been blackened in Australia.

"some visitors to Australia risk being repatriated to stay in Australia because they can make more money in Australia," according to an internal document from the Commonwealth of Australia's goverment.

Some black people even plan to spend more than a decade in Australia after having children in order to apply for citizenship, the document said.

Officials at the new Home Affairs Department have called for more stringent screening of airports to prevent illegal immigrants from re-entering the country.

They also called for better data matching between the Australian Revenue Service (ATO) and Human Resources to identify illegal immigrants hidden in the community and impose severe fines on their employers.

The report also recommends monitoring illegal immigrants by opening bank accounts, renting property, using day-care services, and getting a driver's license.

The police will even check the passengers' valid documents on the train!

The helplessness of the black people

(The Conversation), an Australian online news review site, conducted an online survey of "illegal workers in Australia", involving a total of 46 illegal workers. Most of them are between the ages of 20 and 40. During the interview,

"I don't want to live in Australia," said an illegal migrant worker. "I came to Australia to earn money and feed my family. So most of us will eventually choose to return home. Basically, we all came to Australia to make money to support our family. "

"I'm a widow," said another female illegal migrant worker. So I have to pay for my children's tuition and living expenses. That's why I came to Australia, just to have the money to raise my children. "

During the survey, the vast majority of respondents came to Australia through tourist visas (no legal employment rights). Some interviewees reported that some black-minded agents targeted groups that could not afford visas to work abroad or had no access to state work. For example, a retired teacher in his fifties said: "the agencies advertise. To tell the truth, the first time I saw that kind of advertising, I said I could go abroad and earn a lot of money. I thought this was my chance to work in Australia. "

The interviewee and her husband were reported to have borrowed A $8500 from the agency before arriving in Australia, while her husband remained in the country before retiring. But it was not until she arrived in Australia that she realized that she was holding a tourist visa, which was not allowed to work in Australia.

There's a young man who has been cheated by the black intermediary. He was also cheated by the intermediary in the travel visa to Australia to find it illegal to work. The man's parents have died for years, and he has an 18-year-old and 19-year-old sister who needs to be dependent.

The agents made a lot of money under the guise of "working abroad." Despite false and misleading information, it is difficult for regulators to investigate these agencies.

Although illegal workers are widely believed to be concentrated in plantations such as vineyards, the results of this online survey show that illegal workers exist in many industries, including hotels, massages and cars.

In addition, research shows that some employers and sub-contractors are often exploited for illegal labour. Some of the respondents said they would face the risk of being sent back to the country by the employer if they leave or complain. One of the respondents said:

"whatever the salary, we can only accept it. Although we feel that the salary is low, we have no choice. "

Another interviewee said:

Employed by a subcontractor, 3 months of work has not been paid. In the end, it didn't come to an end.

These problems are difficult to identify and resolve because many illegal workers are repatriated as soon as they are discovered and no one is really concerned about their state of work and situation.

The dilemma of turning from black to white

As the saying goes, "if one goes the wrong way, it is hard to turn back for ten years." as far as the black people are concerned, it is in fact the same situation. Once a black people, in addition to the face of a fearful life all day, always found, detained, repatriated dilemma, even if the future would like to "abandon the dark surrender", "from black to white" is also not easy.

We recently came into contact with a case like this:

A boy with a student visa came to Australia to study, about half a year, because of his poor grades, he dropped out of school and started a black job outside. I met a girl with Australian permanent resident status during the job. The two got on well, and the girl's mother accepted the boy as a future son-in-law. The boy told his mother and daughter that his student visa only expired in March next year, that the girl's mother felt that the time was still early, that there was no rush, and that before the expiration of the student visa, it was not too late for girls and boys to go through the formalities of marriage registration. Unexpectedly, one weekend night, the boy went to a friend's party. At the climax of the party, immigration officials "dropped from the sky", surrounded the house and checked the identities of all the people present.

The boy was told that because he had not gone to school, his student visa had already been cancelled by the school and the immigration service had been cancelled. The boy's identity had been illegal, so the boy had no identity with another boy. Was sent together to Villawood's "detention" camp. The boy repeatedly applied for bail on grounds of marriage to a woman with permanent Australian status, all of whom were refused.

As can be seen from the above cases, the Australian Immigration Service, under the leadership of the current Liberal Party, goverment, insists that "illegal non-citizens" are firmly detained, and once detained, it is difficult to obtain "bail". In addition to the risk of being held in custody, even if it has not been discovered, the "black" history of "black people" who have been "black people" in Australia so far will pose a great obstacle to future visa applications.

Under immigration law, former "black" people, even after leaving Australia, may face "no-go" (Exclusion Periods) restrictions if they want to reapply for a visa to return.

The "no-entry period", also known as "Re-entryban", refers to certain persons who, for some reason during their previous stay in Australia, are not allowed to be granted Australian visas again within a certain period of time.

These include: those whose visas have been cancelled; those who have breached visa terms or exceeded the time of visa approval; those who have been repatriated or deported by the Australian goverment; and those with specific groups of people (such as Australian-assisted students).

It can be seen that this limitation period is mainly for "Hei Min".

If the entry restriction period applies to a person,

  • When he applies for a temporary visa, the length of the "entry restriction period" is three years;
  • If he applies for a permanent residence visa, he will not be affected by the "re-entry restrictions", but the Immigration Board will consider the past "black" history and will make adverse decisions on the visa application.

We still have many guests. We have a "black" history of "black people" in the past. As a result, although we later took Australia's permanent residence, some people may subsequently join Australian citizens, but as a result of this history, they want to be their own children, parents. Brothers and sisters come to visit relatives, no matter how good the applicant's conditions, that is, the family and friends in Australia have been "black", the Immigration Service is not to grant family visit visas. Some people think that to become an Australian citizen, this period of "black" history can be washed "white." I do not know that the immigration system, there are 1510 records, even if turned into a citizen, once history, but also by immigration officers to determine whether to give "black" people related to the family members to grant a new visa.

Therefore, everyone, where possible, must ensure that their identity is legal. Even if you want to stay in Australia, can not find a legal way, do not lightly "black down." Once "black" has come down, become "illegal immigration", want to "black" to "white" outlet, it is not easy thing.

Give my friends a wake-up call

So what problems should we pay attention to when we are already "black people"?

(1) there is a legal tip for "black people": when caught by immigration officials, before being held in custody, immigration officials will examine "illegal non-citizens" as required by Australian law and verify the relevant information. These include: what are the special circumstances in which the interrogation of the "black people" should be considered by the Immigration Board not to be held in custody? Is there any other visa to apply for, or what kind of visa is being applied for? If so, it is possible for immigration officials to consider not taking custody and granting short-term bridge-crossing visas to E. In this way, the "black people" either within the prescribed time to report to the Migration Board, arranged to leave the country voluntarily; Or apply for the visa within the prescribed time frame. Upon submission of the visa application, the applicant will be issued a new cross-bridge visa to maintain the identity of the further legal.

In the case of the above.

The boy should have told immigration officials about his spouse relationship in Australia before being sent to a detention camp, and told him that he was going to marry the girl in the country, apply for a spouse immigration visa, or that the visa materials were being prepared. Immigration officials can talk to the girl and her mother on the phone to confirm their spouse relationship and future plans, such as getting married, applying for a spouse visa, and so on. All of this helped convince immigration officials that the boy was trying to "normalize" his identity!

On the contrary, not knowing this common sense, "nothing to worry about, something to worry about", when immigration officials appear, the brain is empty, scared out of courage, then can only be detained. And to the detention center, think again "bail" to come out is very difficult.

(2) when "black people", they must be looking for a way to change from "black" to "white". Among them, obtaining Australian status through spouse immigration is the best choice for most "black people". But if you don't want to leave Australia and want to find someone to marry in the country, you can change from "black" to "white", a path that has become more and more difficult.

For a long time, "black people" in the country often have the idea that as long as they find a partner, have a de facto cohabitation relationship, or get married, they will submit an application for a spouse's immigration visa within the territory immediately. Then from "black" to "white", you can not leave Australia. This can be said to be a good way to gain Australian status during the past Labour goverment. But since the Liberal Party's goverment came to power, scrutiny has become increasingly demanding in cases of "black" to "white" applications for a spouse's immigration visa.

In particular, in July 2014, the incumbent Liberal Party, goverment, revised the policy of "overwhelming reason (Compelling Reasons)", and the Migration Board spared no effort to combat the "three kinds of people":

  • (fail to comply with their visa conditions); for non-compliance with visa terms
  • (deliberately manipulate their circumstances to give rise to compelling reasons); that deliberately creates circumstances to produce "overwhelming reasons (Compelling Reasons)"
  • Can leave Australia to apply for a spouse visa abroad, but deliberately do not leave (can leave Australia and apply for a Partnervisa outside Australia.)

Many factual cases have proved that since July 2014, it has become very difficult for a large number of illegal residents in China to move directly from "black" to "white" through spousal migration.

Therefore, in the current situation, even if the vast majority of the "black people" have established a stable marital relationship in Australia, they should not fantasize about the direct change from "black" to "white" in Australia. Still be ready to leave Australia, go abroad to apply for a spouse visa, so as to achieve the "black" to "white" plan. Both the Australian goverment, and the Immigration Service have repeatedly reiterated that if there is no real "overwhelming reason", "black people" must leave the country first and apply for a spouse visa abroad to return to Australia. Domestic spousal immigrants do not give the green light to those who have not complied with Australian law.

Conclusion:

Please cherish your visa just as you cherish your life. Before you become a "black man", please make sure that your identity is legal, if possible, and do not speak lightly of "blackening". As the saying goes, "open the bow without turning back the arrow", your dark, will bring you endless trouble, the future from "black" to "white" is not a simple thing.
