2, occupation list UPDAT

The reform of temporary and permanent employer-guaranteed visa programs will be accompanied by another change in the list of occupations.

Including:

  • More jobs will be added to employer-sponsored projects in remote areas
  • Some existing occupations will move between short and long tables
  • The caveats of some occupations will change.
  • Cases that have already been handed over for trial will not be affected
  • Different visa programs will still maintain different occupational lists as they are now

4. Renewal of employer guarantee qualifications

After the March 2018 reforms, existing 457 employers could reapply for a new five-year validity before expiration.


5, TSS visa labour market test

In addition to the exemption from labour market testing for national applicants who have signed trade agreements with Australia, other applicants must meet the LMT, or labour market test requirements, before submitting their TSS visa. Because China and Australia signed a free trade agreement in 2014, Chinese applicants are not required to pass the labour market test.


6. Work experience requirements for TSS visas

According to an announcement by Australia's goverment on April 18, 2017, TSS visa applicants must work for at least two years in a nominated position or related occupation prior to submission. The related requirements are broadly as follows:

  • The Immigration Board will be flexible in considering and recognizing work experience in the light of the actual situation of the nominating profession and industry
  • Relevant work experience must be obtained in the last 5 years prior to submission of the application and is a full-time job. Part-time work experience is likely to be recognized
  • Research work during a master's or doctorate period may be considered to meet the requirements of work experience for certain occupations, such as medical and research-related positions
  • Work experience gained through clinical internships or meeting TSS job requirements, if nominated for a medical-related position
  • Internship experience gained in career year courses is considered to be part of the job requirements for the position concerned. (note: currently only applicants for accounting, IT and engineering positions can attend year of career courses)
  • For nominees for performing arts positions, the performance experience already in school may be considered to meet the requirements of the TSS jo


Under the new TSS system, employers can choose when applying for nominated posts:

  • Nominated position-stream to determine relevant visa application
  • Length of employment-the stream of the visa application determines the length of employment ranging from 1 to 4 years, which affects the validity of the visa applied fo


8. For the renewal of the TSS visa, the main sub-applicants for all the TSS can be signed in Australia or abroad. However, for short-term career list applicants, if the primary applicant meets all of the following conditions, it must be signed abroad:

  • TSS visa holding more than 1 short-term position
  • The most recent TSS visa was handed over in Australia
  • This requirement does not conflict with any free trade agreements

Note: TSS visa holders holding two short-term occupations in a row and the second visa being signed within Australia must apply for a TSS visa for the next short-term occupation from abroad. However, such applicants may not meet the requirements of the GTE. 9, all TSS visa master applicants under the new section 8607 will have to meet the new clause 8607-any change in the nominated position, even if the employer does not change, must be approved for new nominations and visa applications before the new position takes office!


The permanent employer-guaranteed visa reform, which began in March 2018

The key reforms for projects 186 and 187 starting in March this year are broadly as follows:

  • Only the long-term occupation list MLTSSL applies to 186th and 187th visas, and additional occupations will be offered to the employer-guaranteed category in remote areas
  • Wage requirements: new market wage requirements, including minimum wage TSMIT will apply to both ENS and RSMS visas
  • Housing requirements: the transition from a temporary residence to a permanent residence will be extended from the current 2 years to 3 years
  • Working experience: at least 3 years of relevant work experience is required
  • Age: all applicants must be below the maximum age limit at the time of submission-45 years
  • Will the existing age and English exemptions change? Existing exemptions will be retained.

In particular: the reform proposals announced on 18 April 2017 do not specifically refer to permanent employer guarantees, namely, 186 and 187 visa age and English exemptions, but with effect from 1 July 17, the exemption from high salaries in the English language was lifted, There is no transitional policy!
