The 2016 immigration amendment bill was discussed in Parliament not long ago. The biggest change in the revision is for spouse visas. Specifically, this bill reforms the following parts:
1. The guarantee of spouse immigration needs to apply for guarantee qualification, the guarantee qualification is separately from the visa processing, the guarantee qualification examination is passed, the applicant can submit the visa application;
2. A temporary visa for spouse immigrants will be granted for a period of validity, and subsequent pr applications will be made within the duration of the residence period, and will be invalidated if the application has passed the validity period. That is, after the 820 approval, there will be a validity period, 801 application needs to be carried out within this validity period;
3. Information about the spouse guarantee person will be shared with the spouse signature applicant;
4. A temporary spouse visa and a spouse permanent residence visa will be charged in stages;
5. Spouses guarantee people need to meet certain conditions, such as no crime, law-abiding citizen and so on;
Impact of the new bill:
The first is the timing of visa processing: since guarantee qualifications need to be reviewed first before they can apply for visas, separate processing of guarantee qualifications and applicants` applications will necessarily increase the entire visa application time. For the already slow spouse sign (the current 1-2 years of trial time) no doubt added to the pain. But for immigration, increasing trial time can help verify authenticity.
As soon as the visa expires, applicants who want to get a spouse visa for a bridge visa may be in trouble. The timing of the guarantee qualification hearing does not specify that if an applicant`s visa is due to expire, it will have to go through the qualification process before it can be applied to cross the bridge.
Not anyone with an pr or citizen can be a guarantee: under the new law, a spouse, guarantee, needs to meet the criteria to qualify for an guarantee, and once the guarantee qualification fails, don`t think of anyone else guarantee. Current guarantee qualification requirements: 1) provide all countries that have lived for 1 year in the past 10 years without crime; 2) guarantee quota limit, 2 guarantee quota in a lifetime, guarantee 2 spouses need to wait for 5 years.
