  • There's a serious criminal record, (substantial criminal record).
  • Tried to escape immigration detention or committed crimes during / before and after immigration detention.
  • There is reason to suspect that the person is a member of, or has any association with, an organization. Such organizations refer to organizations that violate criminal law.
  • Referring to this person's past and present criminal record or the person's past or present behavior, it is found that the person does not belong to the "good character" (good character).
  • When he enters Australia, he will pose a 'threat' to the safety of the Australian people, that is, he will be involved in Australian criminal offences, sexual assaults, or in acts of violence that are harmful to social security.

To put it simply, it depends on whether you have serious criminal acts or serious conduct problems. It would threaten the interests of the Australian public if people with such "conduct" clearly had major problems to stay or even emigrate to Australia. The "substantial criminal"-"serious penalty record" in the conduct test consists mainly of:


  • Sentenced to death or life imprisonment
  • Sentenced to imprisonment for more than 12 months

  • Convicted of mental problems and sent to the relevant detention centre (i.e. guilty of a crime but not imprisoned for a number of reasons)
