Is naturalization rejected but calls for injustice: is it all caused by translation?

Australia`s naturalization reform has been under way for more than a year, and the review of version 2.0 was back on the Senate agenda last month after being rejected for the first time.

While everyone is waiting for the result, the Australian Prime Minister and immigrant minister have changed again. I wonder if the naturalization reform will also usher in a new turnaround.

However, it is an indisputable fact that the time of the naturalization trial is now greatly extended because of the reform, and it is often necessary to wait more than one year, or even two or four years!

Is naturalization rejected but calls for injustice: is it all caused by translation?

In this situation, it is even more important to be able to submit a complete and accurate naturalization application, one can shorten the trial time, second, it also reduces the chances of being denied.

One applicant, however, didn`t take his naturalization application seriously, and not only was he rejected, but AAT`s appeal failed to make it back.

Do you want to hide it or don`t mean to miss it?

The applicant, who has lived in Australia for 22 years, arrived in Australia on a remote employer`s guarantee visa in 1996, and in 2011 he received a RRV visa from PR,.

In February 2017, S filed an application for naturalization, and he answered NO. on all questions about the history of crime. As a result, in September, his application was rejected! The reason is to conceal the history of crime, "do not meet the moral requirements"!

As early as 2007, when Mr. S worked as a cook in a restaurant, he was complained by several female employees over obscene twice, and he assaulted others on an impulse, and S was sentenced to six months` imprisonment with a three-year suspended term.

Is naturalization rejected but calls for injustice: is it all caused by translation?

Although it was obvious that he had made a mistake, S was dissatisfied with the refusal of naturalization and appealed to AAT. The reasons are:

I am not good at English, rely on translation, some places have not answered right;

AFP issued a no-crime certificate showing no criminal history, and he responded accordingly.

S also claimed to speak only basic English and commissioned an immigration lawyer, who helped fill out and submit the application form.

All the information provided to the lawyer was Hindi, and then a girl translated it, but the girl`s Hindi was also stuttering.

As a result, S believes that it may have been a mistake in the translation process that led to the lawyer not getting the correct information. In short, he thought it was an "unintentional mistake".

And he didn`t ask for help from his family because he wanted to surprise his family after naturalization was approved.

However, AAT believes that such an important matter, Mr. S was so careless that his explanation was not accepted, and the appeal failed.

It is true that Australia`s current naturalization requirements are not high. But in fiscal year 2016 / 17, there were still 4151 applications rejected under the most common conferral branch!

The common reasons are as follows:

Naturalization test failed

Of the 4151 applications rejected in FY17, 1866 failed to pass the citizenship test, accounting for nearly half!

Most of them are not prepared or English is good enough, but some of them may be because of bad luck! This fiscal year ended April 30, another 1597 people failed the naturalization test, 5.5% of them are one-third of the difference!

The downside, however, is that the answers to individual questions in the official preparation for the naturalization test, such as Australia`s population of 22 million in 2009, are now 25 million. If the examinee unfortunately encountered this problem, perhaps a small point is here.

Unqualified conduct

In addition to naturalization tests, applicants are required to pass a conduct test and may be denied a criminal record. The previous applicant belongs to this category.

Of course, not to say that the burning and looting, fighting, etc., is a crime, after all, this is only a few. Frequent traffic violations in daily life may also become a roadblock to your naturalization!

In short, the character mentioned in the naturalization application is not exactly the same thing as the good and bad people we usually understand. It usually takes into account the consistent moral character of the individual rather than the specific or temporary character. So remember, don`t do bad things, even if it`s not obvious!

Departure time is too long

Away from Australia for a long time, the Home Office may think that you have no plans to stay in Australia or that you are not closely connected to Australia.

A lot of people get PR and think everything`s going well, live back home, or even work for a long time at home. I do not know that this will make it difficult to apply for RRV later, but will also affect future naturalization applications.

Identity problem.

This mainly refers to the identity is unclear, inconsistencies or fraud, and so on.

Naturalization is the last threshold for authentication, so the content is broader and stricter. Problems that may not have been identified in previous visa applications are likely to be uncovered in naturalization applications.

Participate in extreme terrorism organizations or activities

This is more serious than disqualification, I suppose no country would want such a person.

epilogue

In addition to naturalization, visa applications are also very strict on the conduct of the requirements, so friends must be strict restrictions on their behavior, do not lift stones and smashing their feet.

If you have a bad record but deliberately conceal it, you may violate the PIC4020 provisions, resulting in visa rejection, and those who have already been granted a visa will also be cancelled.

And for some unintentional illegal acts, if you are not sure how serious it is, it is recommended that you consult professionals as soon as possible, and do not act on your own!

The way to study abroad and emigrate will never be smooth, but as long as we are properly prepared, we can jump over many holes.
