It`s harder to stay in Australia by appealing!

The Administrative Appeals Tribunal (AAT) is responsible for adjudicating visa and expulsion disputes between migrants and refugees.

It is reported that a review recommended changes to the Administrative Appeals Tribunal. Foreigners who fail in future visa appeals may have to leave the country in a shorter time.

AAT has a variety of functions, but mainly to review visa decisions. For example, when the Interior Ministry or the Minister decides to cancel a visa, expel skilled immigrants or refugees, the person concerned may appeal through the AAT against the decision. But many people choose to appeal in order to extend their stay in Australia, resulting in a backlog of AAT cases.

Recently, former Supreme Court Judge Ian Callinan presided over the review of AAT. He believes the surge in immigration and refugee cases has left the AAT in trouble, becoming a bloated bureaucracy.

"the number of immigration and refugee cases is on the rise, 43 percent more than last year."

To ease the pressure on the Appeals Tribunal, he suggested changes to the rules of the Administrative Appeals Tribunal.

The proposed changes include strict restrictions on subsequent evidence; allowing employees from the Ministry of the Interior to attend AAT hearings and explaining the reasons for the cancellation of visas; and repatriating foreigners who have failed in the final appeal at a faster rate.

It is reported that the findings and recommendations of the review will be presented to the Federal Attorney General Christian Porter. this week.

If the proposal is accepted, visa applicants may no longer be able to obtain a significant amount of stay in Australia through appeal.
