The 27-year-old Shahn Lefoe faces a local court in Melbourne on Thursday, according to The Age reports, but his defense lawer argued that Lefoe thought the victim was 21 years old and that the other party had voluntarily relationship..

Senior police officers from the Westgate sexual crime and Child Abuse Investigation Team Jarrad Brookman, however, told court, they had met at a party in August.

judge Kieran Gilligan said that without the victim photo, he could not verify whether the child looked more like 12 or the defendant said 21.
Police officer Brookman said the defendant moved to Melbourne at the end of 2018 with his parents and lived in Australia with a special category visa.
He objected to the bail, of the accused and stated that if bail, accused would face a "significant risk of escape" and if his visa was subsequently revoked, he could be detain..
The judge Gilligan did so on the condition that he Lefoe bail, reported to the Werribee Police every day and could not leave Australia and live in his parents` home:
"In my opinion, this is not an unacceptable risk. "
