It is reported that the man`s name is Jacob, 52 years old. He had previously worked as a printer at a newspaper in Perth. Jacob described this as unfair dismissal, but was rejected by the Fair work Council (Fair Work Commission). According to the Sydney Morning Herald, his boss fired Uber when he found out he worked part-time to open Uber. The Fair work Committee agreed with the company`s practice that he breached the contract by doing "other work" without permission. The ruling could set a precedent for similar disputes.

Commissioner Williams (Bruce Williams) said it was fair for Jacob to be dismissed from his job because he did not report it honestly.

"in this case, to a large extent, Jacob himself created the situation." Uber through publicity "extra income" to encourage vehicle owners to join the platform. Uber did not announce the proportion of drivers who drive part-time. But the spokesman only said: "people choose carpooling service because of its high flexibility." Jacob initially denied working for Uber and later argued that it did not constitute an employment relationship. Uber defines chauffeur as an independent contractor, but labor law experts say chauffeur drivers can also be considered employees under Australian labour law.
