Trevor Bird, 68, of (North East Road), north-east of (Houghton), Horton, was killed by a retrograde car in September 2012, according to the Australian Broadcasting Corporation. The driver, Bo Xi Li, was 30 years old.

Li was charged with one count of dangerous driving leading to death and three counts of dangerous driving causing injury to another person. The jury found guilty. It is understood that the car at that time reached 104 kilometers per hour.

The victim`s partner, Timea Dixon, was also in a minivan and was hit and injured. Two other passengers in the vehicle were also injured.

Judge Michael Boylan today sentenced Li to five years in prison at home, according to the latest amendment to South Australia`s penal code, which came into effect three weeks ago.

The judge said that since Li had violated traffic rules in the past and was unrepentant, he "did not intend" to impose a suspended sentence.

"our community simply cannot accept such reckless behaviour as you.

"this is a serious violation, and court sentencing needs to reflect that."

The judge admitted that Bird`s death hurt his family and partner.

"nothing can be said or done to relieve the pain."

Dixon said out-of-court that the driver was able to serve her sentence comfortably at home, and she felt very angry.

"five years` imprisonment at home won`t make up for his crime.

"and he never showed remorse. He took a life and hurt others, but he didn`t care. "

While incarcerated at home, Li needs to wear electronic surveillance devices that allow him to walk out of the house in a job or emergency.

"he can still work, sleep with his wife, play with his children," Dixon said.

Li said it would appeal.
