In Australia, it is something some people do when couples break up and hide their children and punish each other. Even more, take the child back to China, and do not let the child and the other party phone or WeChat. What if something like this happens? Let's take a look at what relief measures are available in Australia's Family Act.
Recovery orde
A family court may grant an order to retrieve a child. If the child is hidden and cannot be found, a party can apply for court approval for the recovery order. In applying for a recovery order, the applicant must write these words:
"Court officers, all Australian Federal Police officers, State and Territory Police officers:
Please help me find my child.
"when there are good reasons, please stop and search for suspicious vehicles, ships, planes, etc. Please enter and search all suspicious buildings."
As applicants, it is necessary to inform the Tribunal in detail:
- The history of the relationship between oneself and the child;
- There are no previous family court decisions;
- Children often live in;
- when will the child be taken away
- Where the child might be;
- What I spent trying to find a child;
- Why is it best for a child to be around him?
- If the child is not taken back to their own side, will have any impact on the child, etc.
The court will make a judgment on all the circumstances, whether or not to approve the recovery order.
当找回令被批准，一般申请人会将找回令交给联邦警察。联邦警察会动员所有必要的人员，找回小孩。
防止小孩出国
为了防止对方将小孩带出国，一去不复返，申请人可以向法庭申请以下命令：
- 阻止发护照给小孩；
- 要求对方将小孩的护照交给法庭保管；或者
- 阻止小孩离开澳洲。
当法庭下命令阻止小孩离开澳洲，联邦警察会将小孩的名字列入机场观察名单，配合法庭阻止小孩出境。
以上三种方式，都可以有效防止小孩被带去其它国家。
当然，如果因为合理原因，需要小孩离开澳洲一段时间，一方也可以请求法庭取消防止小孩出国的命令。在审查过所有材料后，如果法庭认为确实合理，会要求这方家长支付一定量的保证金，保证小孩一定会按时回来，之后，批准允许小孩出境。
