What if you accidentally 'black' in Australia? These ways of self-help need to be understood.

Last fiscal year, Malaysia had the most black people, followed by China. Once black, the visa and immigration program will be severely affected, facing a three-year or even lifetime ban on entry.

Australia, as one of the ideal paradise for studying, working and vacationing, has attracted a lot of people. Some people come and don't want to leave again, even choose unconventional means to stay. Without Australian status or a valid visa, they became illegal non-citizens, commonly known as black citizens.

The current situation of the Black people in Australia

According to data released by the Australian Immigration Service, as of June 30, 2017, about 64600 people were illegally residing in Australia. 6670 of them stayed for 15-20 years, and 12080 of them have been in the dark for more than 20 years!

It is said that at least one person is 40 years overdue in Australia! I don't know if it's death or life now.

Of these, 70% came to Australia with travel visas, about 15% (9690 people) with students, 3% with holiday visas for work, and fewer than 700 people who had previously held bridge and immigration visas.

In the 2016 / 17 fiscal year, 9440 Malaysian citizens ranked first in Australia, followed by China, with 6500, followed by the United States, with 5710.

There are about 3680 people in Britain, 2780 in Indonesia and 2730 in India. Black people from South Korea, the Philippines, Vietnam and Thailand are between 2, 200 and 2, 800.

Immigration has not announced how many triads work in Australia, with an estimated 20, 000. Of the 12966 black people captured in fiscal year 2016 / 17, 1756 were illegal labourers.

Nor did the Immigration Service say how much it spent on the capture of triads, but it spent A $72.4 million on management activities alone.

Black encyclopedia: as a general rule, there are only the following reasons for the blackening of the original capsule:

  • Do not have a visa, such as to smuggle into Australia
  • Residence visa expired
  • Violation of visa terms, resulting in visa cancellation
  • The lack of good conduct led to the cancellation of the visa
  • Information on entry documents and entry cards is falsified.
  • If found, they face immediate repatriation to (removal), or temporary detention in detention centres pending deportation, unless a visa can be applied for.

Note that the cost of being repatriated is to be borne by itself.

Deportation (deportation) is different from deportation. Generally speaking, Australia's PR or certain New Zealand citizens are deported only with specific expulsion orders.

PR may be deported if he commits a serious crime and is sentenced to more than a year in prison, or is deemed to be a threat to Australia's national security.

After serving their sentences, criminals either leave the country directly from prison to the airport or temporarily in detention centres, and then arrange to leave the country as soon as possible.

Once you become a black citizen, there are the following options:

  • Continue to blacken: if unaccompanied, hiding in a foreign country for a long time is not a small test of one's spirit, body and economy. Be cautious!
  • Apply for spousal immigration: in Australia, it happens to meet the requirements of spousal immigration, but it is also possible to obtain Australian status through the formal channels. This is also one of the few ways for the black people to wash white.
  • Student visa holders are allowed to submit student visa renewal applications within 28 days of overstay. But remember: there is only one such opportunity in one's life.
  • Voluntary exit: voluntary exit can avoid detention, but whether it is voluntary or repatriated, it is possible to face a ban on entry (re-entry ban).) A short period of 3 years or a lifetime ban on entry.
  • If they are not detained, the triad will still have a chance to apply for BVE:.

  • Arrangements for departure
  • Application for substantive visa
  • Waiting for visa results or appeal results
  • Request for intervention by the Minister of Immigration
  • If the visa was cancelled for moral reasons, it would be detained and could not apply for BVE, unless the cancelled visa was taken back.

If the BVE application is rejected, no further application can be made within 30 days.

If BVE is approved, he can stay in Australia for a few more days, either voluntarily leaving the country after expiration or waiting to be arrested and repatriated.

    Prohibition of entry

If you overstay for more than 28 days (such as student or travel) or if your visa is cancelled for some reason, you may face a three-year ban on re-entry to Australia.

Note: this re-entry ban is generally applicable to re-applying for a temporary visa. If there are special reasons, you can apply for exemption. Neolithic has assisted several applicants to waive the ban for three years and has successfully returned to Australia to study or work.

If you apply for a permanent residence visa, you will not be subject to a ban, but the Immigration Board will also consider whether to grant a visa based on the applicant's immigration history.

    Anti-triad operation

Marianne Dickie, a teacher of immigration law at ANU, said there were so many black people in Australia that immigration authorities were not in place to pay the same attention to the issue as refugees.

Senator Griff said nearly 20, 000 people had been black in Australia for more than 15 years, an irony to the border authorities. This means they have seized 20, 000 local jobs. Therefore, the government needs to make great efforts to stop the black people from staying in Australia.

But Jonathan Granger, a practising immigration lawyer, argues that immigration's work has been productive. Although there are so many black people, since 2010, the number of tourists and foreign students has risen sharply, to almost 500000 people. The number of black people has increased by only 6%, to about 60, 000.

A spokesman for the Immigration Department also said that the number of black people is actually less than 1% of the annual arrivals, and that some people are only a day or two or a few days overdue. But there are also a lot of people are deliberately black, because the probability of being found is relatively low.

Immigration said it would take "targeted compliance actions" to target black people. If the black people are caught, as long as they cooperate, they will not normally be detained.

According to netizens, shortly before the immigration and police arrested a group of black people, the site of the Chinese district of Auburn and Burwood were raided.

They also randomly checked visas on trains, even vehicles passing by, taking with them more than 30 black people at the Auburn train station alone.

In fact, this is not the immigration authorities temporarily intended to search for black people. In February, immigration and police raided a Queensland farm and eventually arrested 27 black people.

In March, immigration also raided several motels in Western Australia, arresting dozens of illegal workers on the spot.

In short, the consequences of being a black citizen in Australia are very serious, and we must strictly abide by our visa provisions and laws and regulations.

Apply for what kind of visa you do; renew your visa before it expires. Don't ruin your good future by a moment of neglect or confusion. Visit the immigration VEVO page or download VEVO App, at any time to inquire about your visa maturity date. Keep in mind that your visa maturity may not be the same as that of your classmates.

If you don't know the terms of your visa, or you don't know your future visa plan, you should check with an immigration agency.
