Chinese court judgment enforced in Australia (2)


If the Australian court recognizes the decision of the Chinese court, that is, the Australian court recognizes that the Chinese court has judicial discretion over something, the ruling must also have the following characteristics in order to be enforced in Australia.


First, the judgment must be the final judgment of China's court, and there is no chance of further appeal;

Second, the identity of the parties to the proceedings must be clearly and publicly disclosed;

Third, if it is aimed at people, it must be a debt with a definite value.


In series (3), it is discussed that even if the Chinese court judgment meets the above conditions, the Australian court can still refuse to enforce several cases.
