The family appealed, arguing that, combined with the scene evidence, the judge had made a mistake in several ways. However, the appeal was dismissed last week.

Judge Philip McMurdo said that according to DNA and photographs at the scene, there was blood on the driver's side of the airbag with the boy's blood on it. Plaintiff face, tooth injury, this may be the source of blood on the airbag.

At the same time, McMurdo rejected the assumption that when the boy's father moved his son out of the car, his hand accidentally stained his son's blood on the airbag.

In the end, McMurdo decided to dismiss the family's appeal and ordered it to pay the fees.
