Federal court does not support cuts in funding appeal, the biggest Islam school prospects are doubtful

The future of Australia`s largest Islam school is in jeopardy as the federal court does not approve an appeal against a $19 million cut in federal government funding.

The Malek Fahd Islam school in Sydney`s west side cut funding two years ago because of weak regulation and profitable operations, while the then education minister, Simon Birmingham, cut funding.

The school has 2500 students from kindergarten to grade 12, and their largest campus is in Greenacre. Over the past two years, they have continued to operate through appeals in lower courts and internal reforms, including changing the school board and reforming relations with the landlord, the Islam Association of Australia.

On Tuesday, the federal court upheld an earlier ruling by the Administrative Appeals Division of the new state.

On appeal, the school said "things have changed under the management of the new management" and that it no longer operates for profit purposes.

"the Education Secretary acknowledged that something had changed under the leadership of the new management of the Malek Fahd Islam school, but still believed that the school was operating for a profit." The verdict says.

In a written statement Tuesday, Education Secretary Birmingham said all schools must comply with education laws.
