Ten years of studying abroad
In January 2008, Gurminder Singh held Australian students` first entry into Australia. After completing a three-month language course, Gurminder successfully enrolled in the Diploma of Hospitality Management, program for one year in April 2008.
At the end of the year, however, Gurminder failed to get his diploma. Over the next nine years, he enrolled in a number of courses, but did not complete them.
In the meantime, Gurminder fell in love with a Nepalese girl. But in the end, under family pressure, parents arranged to marry an Indian girl.
After marriage, India`s wife came to Australia to join his student visa. Soon, the wife expressed her wish to read. Unable to pay for both students at the same time, Gurminder chose to drop out and let his wife go to school.
The two men took wife as the main application, Gurminder as the deputy application, and submitted a new visa application and was approved smoothly.
However, not long after the visa was granted, the marriage of the two broke down. No longer a family member of the student signer`s master holder, Gurminder soon (September 2014) received notice from the Immigration Service to cancel its student visa.
Thirteen days after receiving the notice, Gurminder re-submitted a new student visa application, this time the Commercial Cookery certificate course and Diploma in Hospitality.
In response to Gurminder`s visa application, the Migration Board expressed doubts about his true intention to apply for a visa, arguing that Gurminder simply used student visas as a way for him to stay in Australia, citing the grounds that he refused his visa application.
Appeal failure
In January 2015, Gurminder filed an appeal against the Migration Board`s decision. In the appeal, Gurminder said he had wasted his precious years of youth and lost his family over the past few years. This painful experience has made him grow up and realize the importance of learning, and now he is eager to return to school.
On appeal court, Gurminder also elaborated on his plans for the future of his new curriculum, planning to return to India after graduation to open a specialty restaurant that combines Indian and Australian culture, with which his retiring father will run the restaurant.
Disappointingly, Gurminder`s detailed and eloquent statement failed to impress judge. Considering that Gurminder stayed in Australia for several years, completed only language courses, and had a long study gap, a history of cancellation of CoE, a history of visa cancellations, and so on, court did not consider Gurminder to be a real temporary immigrant. His application for appeal was eventually rejected and the Immigration Board`s decision to refuse a visa was upheld.
Small new case
Gurminder`s appeal, reminiscent of one of his children`s shoes, was similar to that of Gurminder, but eventually, with the help of lawer, a licensed immigrant from Xiao Xin`s family, he was able to get his student`s signature back.
