There are many possibilities of causing traffic accidents. The blundered party may not be fully responsible, and the other party may also be responsible. So in the event of an accident, it's up to the police.

Dangerous driving is higher than the threshold of negligent driving, and the penalty is heavy.


A person driving at a time when alcohol exceeds the limit or under the action of a drug, or at a dangerous rate for others, or in a manner that is dangerous to others, is dangerous driving.


Where dangerous driving has been created, the consequences may be further divided into the following three cases:


1. Dangerous driving and death;

2. Dangerous driving and causing serious physical injury;

3. Dangerous driving without causing death or serious bodily injury.


The first case, dangerous driving and causing death, is punishable by imprisonment for up to 14 years and other penalties if proven guilty.


The second case, dangerous driving and causing serious bodily injury, is punishable by up to 11 years imprisonment and other penalties if proven guilty.


In the third case, there are two types.


1) dangerous driving for speeding without causing death or serious bodily injury. If convicted and first committed, the maximum penalty is $2200 or 3 months' imprisonment, if repeated, $3300 or 9 months' imprisonment.


2) driving abnormally dangerous driving without causing death or serious bodily injury,

If proven guilty and first guilty, one or more of the following penalties will be adopted by the judge:

Fine, maximum $2200; (optional)

9 months imprisonment; (optional)

Ineligible to drive for at least 12 months; (mandatory)

Indefinite incapacity to drive; (optional)

Not eligible to drive for 3 years; (optional)

If committed within five years, one or more of the following penalties will be imposed by the judge:

Fine, maximum $3300; (optional)

Not qualified to drive for at least 24 months; (mandatory)

Indefinite incapacity to drive; (optional)

Not eligible to drive for 5 years; (optional)

Imprisonment; (optional)


The above cases refer to the sentencing of the party who pleaded guilty or was proved guilty. However, in some cases, although casualties were caused, the perpetrators could still be acquitted.


It is important to remind you that after a traffic accident, even if you believe you are suspected of dangerous driving, you should not assume all responsibility without fully investigating the cause of the accident. Because you don't know if the other person is also wrong, such as whether the other person's mind is clear, whether his eyesight is normal, whether he is affected by alcohol or drugs, whether he is tired driving, whether he is in normal physical condition, and so on.


If the other party is wrong, the other party's fault may be the cause of the aggravation of the accident;

If the other person is wrong, you should not be punished above;

If the other party is wrong, you may get Section 10, that is, no criminal record.
