Overseas Chinese! China is looking into this gray area!

These two days, immigration has become the most popular topic now, however, at the other end of the sea, there is a group of immigrants who have joined the foreign countries but began to fall into a "collective panic", the number of immigration agents of all sizes is busy!

And the source of the panic came from a notice issued by the Ministry of Foreign Affairs!

1. Embassy communication: China does not recognize dual nationality

On the eve of the Chinese New year, the Chinese Embassy in the United Kingdom suddenly published an "Special reminder":

As soon as the news came out, many Chinese who had joined the foreign countries were in a panic.

"my Chinese passport will expire within two years," said Ryan, a dentist who has joined foreign countries. He actually plans to return home in the near future, but is worried that he will return again or be deprived of Chinese nationality because of the fact that he has been found to have joined the foreign country. "my Chinese passport will expire within two years," he said. Now I really don't know what to do with my parents' house. I also intended to send my children to a state-run school in China. "

The South China Morning Post, an English-language Chinese newspaper, says it is not uncommon for overseas Chinese groups such as Ryan to leave the country for study, employment and family, to become passport holders in other countries but not to give up Chinese nationality.

For a variety of reasons, naturalized overseas Chinese have retained their Chinese identity cards and updated their Chinese passports. To make it easier to buy and sell properties in the mainland so that children can be sent to Chinese schools and have access to China's health system.

But now that China's authorities is cracking down on double citizen, analysts say the move is partly to track down illegal gains made by corruption officials.

As said by the Chinese Embassy in the United Kingdom: "Article 3 of the nationality Law of the people's Republic of China stipulates, 'the people's Republic of China does not recognize dual nationality', and Article 9 stipulates that Chinese citizens who settle in foreign countries, Any person who voluntarily joins or acquires foreign nationality shall automatically lose his or her Chinese nationality. For applicants who illegally acquire a Chinese passport in violation of the above regulations, the Chinese Embassy and Consulate in the United Kingdom will cancel or annul the relevant documents, and the person concerned will be refused a visa or denied entry into the country. "

But for many naturalized Chinese citizens, renouncing Chinese citizenship is not easy: it means giving up all the benefits they enjoy in China, including housing subsidies, pensions, schools and health care.

2. "it's hard to get a pension back to the country."

According to the South China Morning Post, people with Chinese status can get "simplified procedures" in dealing with related welfare business, while Chinese who join foreign countries are very cumbersome in handling related issues.

Taking pensioners as an example, the Australian Weekly Daily once reported that a group of "old immigrants" who had settled overseas had repeatedly hit the wall when they returned to China to get their pensions, and were scolded by the young people in their former units as "enough money to go abroad, and enough money to go abroad," as the young people in their former units pointed to their noses. I still have to go back to China to get some money.

This is still the case with pension payments, as was the case with Ryan in the previous article. According to the Law on inheritance, foreign children returning to China to inherit the property of their parents must submit their relevant notarization documents, and at the same time, this notarization document must also be certified by the Embassy, so that the heir may rely on the death certificate of the heir. The will waits for the notarization authority of the real estate place to apply for estate inheritance formalities.

3, "the sequelae of the immigration tide"

There are reports that China's fourth wave of immigration, which began in 2013, is still "in the ascendant". The UN Department of Economic and Social Affairs says the number of international migrants from China rose from 4.1 million to 9.3 million between 1990 and 2013, making it the world's fourth-largest source of international migrants.

However, after seeing more and more "old immigrants" experience the troubles of joining foreign countries and renouncing Chinese citizenship, many new immigrants left their Chinese passports with a fluke mentality. However, such a fluke is unnecessary. According to sources, in order to facilitate the management and censorship of the population in China, the Chinese customs will retain biometric information specific to the human body, such as fingerprints, irises and faces, of foreigners entering the country. And then to compare whether it is a characteristic person or not.

At present, the country's major customs has fully implemented this policy, China's customs inspection in the future will be more and more stringent. All foreigners between the ages of 14 and 70 are subject to scrutiny and include Chinese nationals. The rule is also considered to be a vane for a "double-nationality strike." If foreign Chinese are found to have "dual nationality" when they enter the country, they will be in great trouble.

According to Chinese law, Chinese who have entered foreign countries must immediately cancel their Chinese domicile. Because in the processing of identity cards, fingerprint information will be archived in the public security department. When returning home by fingerprint, it is easy to find out if the household registration has been cancelled.

From 2013 to June 2014, China's Ministry of Public Security has checked across the country for holders of household registrations in violation of regulations, cancelling 1.06 million accounts, including dual nationality, according to data.

On the one hand, it is China's efforts to severely crack down on dual nationality, on the other hand, it is a series of troubles brought about by abandoning Chinese nationality. Many Chinese who have joined foreign countries feel that their passports have become "chicken ribs," and it is a pity that they have abandoned them. Hold but like hot potato, do not know how to deal with. So, isn't there a way to solve all this?

4. China plans to introduce "overseas Chinese Green Card"

The answer is yes.

In 2013, China began to relax its policy on expatriate travel to China, and issued a "notice on issues related to the provision of visas and residence facilities for Foreign High-level talents in China," which states that "for those who cannot apply for a 'green card' in China," May apply for 2 to 5 years valid alien residence certificate. "

However, at present, the "China Green Card" is only issued on a trial basis. There is no evidence that the Green Card in China can be issued in the same way as the permanent residence permits in the United States, Canada and Australia. The card holder is allowed to enjoy pension benefits and simplified procedures in China.

Of course, there have also been reports that China's government agencies are studying and working out solutions to when "China Green Card" is as promised to promote such hot issues as overseas Chinese and overseas Chinese.

But generally speaking, judging from the current information, dual nationality will still be in a grey area in the short term, and the "Chinese green card" that many Chinese and overseas Chinese are looking forward to is still not clearly listed below, but as one netizen said, "those who enter foreign nationality, After careful consideration, vow to another country is tantamount to voluntarily renouncing Chinese nationality. Therefore, we can only say that you Chinese need to consider before naturalization, and be ready to return to China to deal with difficulties in psychological preparation.

On the difficulties encountered by the Chinese after joining the foreign countries, they also hope that the relevant domestic policies will continue to be perfected and humanized, and believe that China's government can provide them with considerate and assured services. Let the traveller's way home no longer "twists and turns".
