Heavy! The House of Representatives of the United States has adopted quota restrictions on waste green cards, and the two major groups of Chinese Americans have been on ice and fire for two days, and they have mixed joys and sorrows.

For Indic and Chinese in Midea, July 10, the day may be included in the history book.

Big news: the highly skilled Immigration Equity Program, the H.R.1044 bill, passed the House of Representatives by an overwhelming margin yesterday.

Next, it will be submitted to the Senate for a vote.

This is definitely good news for Indians in the United States.

For Chinese Americans in the United States, this may be mixed, some people laugh and others cry.

What is H.R.1044?

The purpose of the bill is to remove country restrictions on green cards for professional immigrants and to solve the problem of excessive scheduling.

At present, the United States work and relatives green cards have set national limits to maintain diversification.

The number of people who receive green cards per country each year cannot exceed 7 percent of the total number of green cards in that year, and now the proposal is to eliminate the 7 percent national limit.

If the measure passes the Senate and is signed by President Trump, the change will take place in phases over three years.

After the bill was finally passed by 365 to 65 yesterday, parliament councillor Lovgren (Zoe Lofgren), the bill's proponent, said: "your application should be passed because of your excellence, and your skin color or place of birth should not be a determining factor."

A total of 140000 green cards are issued annually to skilled immigrants in the United States, and most categories require applicants to hold an H / 1B temporary work visa.

India and China are the two groups with the largest number of H 1 B visas, far more than other countries.

According to official immigration figures, in 2018, 73.9 percent of Indians with H1B visas were in the United States, followed by 11.2 percent in China. Because of the large number of people, they face the longest green card scheduling time.

Seeing the above data, you may have seen the problem.

Although Indians and Chinese monopolize 85 percent of professional green cards, the proportion within the two groups is seven times, and Indians are definitely the big winners.

What are the benefits of the H.R.1044 Act?

1. Applicants and their employers do not have to worry about the issue of visa renewal; The applicant's spouse is more likely to obtain work permits;Applicants' children should not worry about their future identity.

two. We will abolish the reduction of 1000 quotas a year for Chinese working immigrants.

3. By repealing the passage of the Chinese Student Protection Act of 1992 (CSPA) bill, the quota for Chinese professional immigrants has been reduced by 1000 per year since fiscal year 1993 (of which the EB3 quota has been reduced by 300 and the EB5 quota by 700) to offset 53000 CSPA green cards (a total of 53 years).

Implementation of specific rules

According to Sina immigrants, the new proposal proposes to remove the current 7% country limit, but the following conditions need to be met on this basis:

In fiscal year 2020, ensure that in countries other than the two largest green card applicants in China and India, green card quotas in the EB-2,EB-3 and EB-5 categories can reach 15 per cent;

In fiscal years 2021 and 2022, ensure that green card quotas in both the EB-2,EB-3 and EB-5 categories can reach 10 percent in countries other than China and India, the two largest green card applicants.

In fiscal year 2020, 2021, 2022, the number of green cards in each country should not exceed 25 percent of the total number of green cards in the United States; the proportion of green cards in non-state areas, such as Hong Kong, should not exceed 2 percent of the total.

In fiscal year 2022, no country's EB-2,EB-3 and EB-5 green card quotas should exceed 85 percent.

Abolition of the 1000 quota reduction per year for Chinese professional immigrants

Increase the country limit for kinship migrants from the current 7 per cent to 15 per cent

At present, with the exception of immediate family members of the citizen in the United States, other categories of kinship immigrants have quota limits, with a total of 226000 quotas per year, but each country cannot exceed 7 percent of the total immigration quota. The new proposal, on the other hand, proposes to raise the country limit for kinship migrants from the current 7 per cent to 15 per cent.

In addition, the new proposal sets a time for entry into force, that is, if it can take effect before the end of fiscal year 2019, it will apply in fiscal year 2020 (October 1, 2019).

Who has an impact on Chinese Americans?

Chinese Americans have almost two very different complexities about the bill.

Hb1B work visa suffered a "disaster of extinction"

Chinese who hold short-term work visas and are applying for a professional immigration green card (EB2/EB3) are strongly opposed to the H.R.1044 proposal.

As mentioned earlier, 7.5 out of every 10 people waiting in line for green cards are Indian and one Chinese, according to this ratio, once H.R.1044 takes effect through the legislation program, after a three-year buffer period.

Early Indian applicants, which account for more than 75%of EB2 and EB3 applications, will eat almost all quotas per year, resulting in a longer schedule waiting for Chinese and other national green card applicants.

There have been many community people with a law background calling that the American Chinese should be united, boycott H. R. 1044.

Petition has also been launched on the White House petition website.

It doesn't sound so scary to wait 3-5 years for a green card to wait for a little ten years in the future.

EB-5 applicants in line cheered;

However, the H.R.1044 proposal is undoubtedly good news for Chinese investment immigrants from the EB-5 Regional Center, who account for more than 90 per cent of the applicants, to some extent ease the current long schedule.

Although the bill does not mention that EB-5, does not want to patronize EB-5, EB-5, which is also a green card for professional immigrants, got on a ride.

On EB-5, Chinese applicants finally have an absolute advantage.

It also means that the scheduling period may be reduced from the current 15 years to about eight years, but it also results in a significant increase in the scheduling time for new EB-5 investment immigration applications and EB-5 applications in other countries, about 11 years (USC calculations).

As a result, it can be said that the H.R.1044 proposal opposes the interests of a large number of investment migrant applicants launched by Chinese EB-5 investors, especially in 2015 and 2016, against the interests of the EB-5 investment migration industry as a whole.

Indian "cover the sky with one hand"

This is undoubtedly a victory for Indian Americans in the United States.

But behind the victory was a successful operation of the entire Indian nation in the United States.

Silicon Valley's tech industry and a large Indian community of science and technology immigrants are behind the bill.

For example, Dumara, an Indian resident of (Olathe), a small town in eastern Kansas, and the original proposed federal congressman, Lofgren, is based in San Jose, California, where Silicon Valley is located.

Dumara's Mr. Kuchhola (Srinivas Kuchibhotla), an Indian engineer, was shoot, a veteran, at a bar in Orasi, Kansas, February 22, 2017.

President Trump condemned the case after shouting to get out of my country before the white killer opened fire, making the case a hate crime of national concern.

Until then, the Dumara family relied on Mr. Mister's work visa to stay in Canzhou.

Later, with the intervention of then congressman Yod (Kevin Yoder), Dumara obtained a work visa and was able to stay in the United States.

In addition, (Immigration Voice), a national grassroots group called Voice of immigrants, came into contact with Dumara shortly after Kuchhola was hit by murder.

The group is mainly Indo-American. The establishment in 2005 is to accelerate the green card program of high-tech immigrants.

The group has since worked to abolish the nationality limit for issuing green cards. Dumara, known nationwide for her husband's death, joined the bill and became an important promoter.

Indians may not be doing much in American politics, but this time they are using their own power to change their lives.

It is reported that the next step of the bill will enter the Senate, if passed, the final delivery of the president.

Whether or not the bill succeeds, it has left a lot of money in the history of American immigration and will change's future history of American immigration.
