Recently, the National Development and Reform Commission, the Civil Aviation Administration, the Railway Corporation and other departments jointly issued relevant opinions, within a certain period of time, appropriate restrictions on specific serious breach of trust on trains, civil aircraft. The opinion has been put into effect since May 1, 2018.

The opinions stipulate that those responsible for acts that seriously affect the safety of railway operations and production safety will be restricted from travelling by train.

(1) disturbing the transport order of railway stations and cars and endangering the safety of railways, causing serious adverse social effects;
(2) smoking on EMU trains or in non-smoking areas on other trains;
(3) those who have investigated and dealt with the resale of tickets, or made and sold fake tickets;
(4) falsely using preferential (waiting) identity documents and using forged or invalid preferential (waiting) identity documents to purchase tickets and take a ride;
5. Holding invalid tickets such as forged or expired tickets or falsely using lost replacement tickets to take the bus;
6. taking a bus without a ticket, crossing the station (seat) and refusing to make up the ticket;
7. Administrative penalties shall be imposed in accordance with relevant laws and regulations.
In the event of acts 1 ~ 3 and 7 which seriously affect the safety of railway operation and production, the railway transport enterprises shall limit their purchase of tickets for a period of 180 days and shall be calculated from the date on which no valid objection has been made upon the expiration of the publication.
In the event of serious acts affecting railway operation safety and production safety Article 4 ~ 6, each railway transport enterprise shall restrict its purchase of tickets.

The opinion points out that passengers who commit related acts at the airport or aircraft are subject to administrative punishment or criminal liability by the public security organs, and will be restricted to travel on civil aircraft for a period of one year.
These include-
(1) fabricating or deliberately spreading false terrorist information involving the security of civil aviation air defense;
(2) falsifying, altering or falsely using another person's identity document or taking advantage of the opportunity certificate;
(3) blockage, seizure, impact check-in counter, security check-in channel, boarding gate (passageway);
(4) carry or consign dangerous goods, contraband or controlled goods as stipulated in national laws and regulations;
(5) where it is prohibited by civil aviation or restricted to the carriage of goods in the carry-on or check-in luggage outside the provisions of the State on purpose to hide;
(6) forcibly boarding, intercepting, breaking into or attacking the cockpit, runway and apron of the aircraft;
(7) obstructing or inciting others to obstruct aircrew, security inspection, check-in and other civil aviation personnel in carrying out their duties, carrying out or threatening to carry out personal attacks;
8. Seizing seats, luggage racks, fights, provocations, intentional damage, theft, unauthorized opening of aircraft or aeronautical facilities, etc., to disturb cabin order;
9, the use of open fire, smoking, illegal use of electronic equipment in the aircraft, do not listen to dissuasion;
10. Stealing goods from another person on board an aircraft.

The opinions point out that those responsible for serious breaches of trust in other areas will be restricted to high-level seats on trains, including soft berths, all seats on G-shaped EMU trains and above first-class seats on other EMU trains. At the same time limit the use of civil aircraft, valid for one year. If the legal obligations are fulfilled within the validity period, the relevant departments shall remove the list within 7 working days.
Those responsible for the breach of trust include:
(1) a party to a major tax violation case that has the capacity to perform but refuses to perform it;
(2) those responsible for serious breach of trust in the field of financial fund management and use, such as fraud, false reporting, fraud, interception and misappropriation, and default on the maturity of debts of international financial organizations and foreign government;
(3) those responsible for serious breaches of trust in the field of social insurance;
(4) Securities or futures shall be fined for withholding funds in violation of the law, and the relevant subject of responsibility of a listed company shall fail to fulfill its public commitments within the time limit;
5. The people's court shall, in accordance with the relevant provisions, adopt measures to limit consumption according to law, or be included in the list of persons who have broken their promises.
